As more and more Australians find there partners overseas the Partner visa subclass 820 and 801 have become one of the most popular visas available to foreign citizens wanting to live in Australia with their Australian or New Zealand partner.
The Partner visa 820 and 801 is a great option for sponsors wanting their partner to both lodge their application and live in Australia whilst their visa is processing. This visa has many benefits over the Partner visa 309 that makes it the most popular Partner visa.
Watch the video to learn more about 820 and 801. Our Migration Lawyer Hanh Ho reviews the visa purpose, common questions, issues and answers. In the video Hanh outline key points and tip in making a successful visa application.
The Partner visa subclass 820 has great benefits, these benefits are basic rights of this visa that the applicant has until a decision is made on your permanent Partner visa subclass 801.
Once the Temporary Partner visa 820 is granted you will also be able to apply for Medicare. Applicants that can prove they are in a long term relationship before lodging an application may be granted 801 visa immediately after the temporary subclass 820 visa is issued. Holders of the temporary partner 820 visa are able to remain in Australia until a decision is made on their permanent Partner visa 801.

Lodging a permanent Partner visa 820 and 801 has a two stage process. To be eligible for a permanent partner visa subclass 801 you first need to be granted a temporary partner visa subclass 820.
You will apply for both the permanent 801 and temporary 820 visas at the same time and pay only one fee. If you are granted the temporary visa subclass 820 you will eligible to be assessed for the permanent Partner visa subclass 801.
In order for applicants to apply for the Partner visa 820 the applicant MUST be in Australia when lodging their application. The appplicant must also be in Australia at the time a decision is made on the temporary Partner visa subclass 820. But you can be in or outside Australia when a decision is made on the permanent Partner visa subclass 801. Our Migration Lawyer Hanh Ho can help you make a plan and track your application to meet the visa conditions should you need to travel to ensure you are in the right place when your application is approved.
The processing time for subclass 801 Partner (permanent) visa is calculated from the date of your application lodgement, appoximatly 2 years after the 820 / 801 application is lodged. Due to high demand for Australian visas it can take several months before a Partner visa 820 application is approved.
A simple way to speed up an application process is to start straightaway, collecting all the documents you need and evidence of your relationship. A lot of applicants make the mistake of slowly gathering these items making a serveral month processing time for the 820 visa application to be approved into a 2 or 3 year waiting period. during this time many things can happen, children are born, children become 18+, more evidence is needed. Starting, finalising, and lodging your application as soon as possible is the simplest way to reduce your processing time.
Not everyone is eligible to get an Australian visa. There are many different reasons why a person can be ineligible, i.e. if you have had a visa cancelled or refused while you were in Australia, lack of relationship evidence, health issues, failing the character test and many more issues. Our Migration Lawyer Hanh Ho can help you overcome many ineligibility issues with her in-depth knowledge and experience of both the Immigration Departments requirements but also the Australian Migration Law. However, should you or your partner not meet the eligiblity requirements, we maybe able to advise you of an alternative visa.
Sponsor must not have previously sponsored more than 1 person and allowed 5 years since the date of the first sponsorship application. And must ensure that divorce procedures are completed in order to not be obstructed when sponsoring new people (Our Migration Lawyer Hanh Ho maybe able to help waive this condition but not any divorce condition. Please call our Australian office (+61) 04 06 888 639 for more information).
